Motorhome too heavy

I updated our Tribute 715 for free, after contacting Autotrail they sent me FOC the relevant documents and new PLATE I then filled in the appropriate form for advising the DVLA of changes and sent it off, All this cost nothing and once the registration document was returned all I had to do was fit the the plating certificate. There are also companies that will do it for but they do charge. From I gather it’s the same procedure to revert back to,original. Hope this helps.
 
We have Bailey 75-2 which comes out of factory at 3850kg but down rated to 3500kg so it could be driven on a car licence.
I’m going to up rate it back to 3850kg it just a paper transaction I went to Sv tech they wanted £260+vat but now going to use JR Consultancy he can doing in a week cost £180 no vat tel 01359250808.
If you want to do it yourself call DVSA for the forms no cost not done this my self.

You need an engineers report to uprate (or one supplied by the manufacturer in the case of Autotrail), so ringing the DVSA for the paperwork and doing it yourself is unlikely to be accepted unless it was previously registered at the higher weight then down plated in which case they might.

That's good, so we now have confirmation that at least two UK manufacturers will provide the necessary info FOC, namely:
  • Bailey
  • Autotrail

Have you checked whether Bailey will do it for you? They uprated our caravan back in 2013/4 for about £70?

Not sure if that makes a difference or not as you still have to submit the info to the DVLA for them to agree and give you a new V5C, so it could simply be that SVTech are just speeding up their own 'engineer' report, or using Bailey to do it for them!
 
I asked Bailey and they put me on to Sv tech to do it.

Still waiting lol.... only sent it last Wednesday... i think its a 4 week turn round.... still plate looks good :-)

4 Ton with 5.5 ton max with trailer
 
O forgot to say Sv asked for a photo of my air assist... sent a mail asking... sent it straight back

... but you still had to send the stuff off the to DVLA, some people think they do it all, but as you've found they don't.
 
I expected to send of v5 thing... hard to see how u could get a new one otherwise :-)... svtech sent out very comprehensive instructions on what to do as well as the certificate thing u need...they also tell u how to get your tax money back as well... assuming u paid in one go... all in all very good service

All well and good so far, but I always feel slightly edgy in case we get pulled, so I'd be interested to know your policy on tolls.
What you shouldnt do is take a photo of your >3,500 kgs V5 and keep it in a seperate folder on your smartphone and also you shouldnt leave one of your weightplates without the uprated certificate so it would be possible to point investigating people in the wrong direction. It would be bad advice if this was ever given to you.

If you were stoped for a check the VOSA bloke would look at the plate on the vehicle and use that weight, he doesn't know individual vehicle weightonly those on the plate
They have access to PNC which shows the weight, and if they are doing paperwork for you, it sort of shows up, so you would be technically "in the poo"

Surely to find out the 'legal' (ie if you can be fined etc) situation it would be better to ask a copper as they are the ones who would fine you?

They are the last people to ask, unless they wear a white hat. If they are wearing the white hat they know traffic law back to front and it is a very black and white matter for them. 3,501 kgs you are breaking the law. ACPO recommendations give you the 5%. They dont have to take any notice of ACPO recommendations (They do though) Sort of like speeding, most areas are 10% +2. So if on a motorway you wont get a ticket under ACPO guidelines til you do 79. However, failing the attitude test (which obviously doesnt exist) orfailing to show remorse for your actions is highly likely to get you a ticket.
The average Police Officer hasnt got a clue about weight limits and I have never heard of a non white hat handing a ticket out.

They probably do :D ... they're obviously waaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaay too busy doing all the plating for those who don't know about JR to be worried by little old me! :D2
 
Providing that there aren't accidents to complicate matters DVSA will only give the OP an ear bashing and not a FPT so long as the weight doesn't exceed 5% overweight ie in total, 3675 Kgs

PS I'm not condoning driving overweight but the only difference in these circs between being legal and illegal is the numbers on the VIN plate (Assuming he hasn't put an elephant in the room.)

From what I have read and my experience it’s virtually unheard of for a private vehicle ( not a van or truck) to be prosecuted for being overweight in the U.K. providing you are within 10% of your maximum plated weight.The usual course of action involves advice and information that will help prevent the situation reoccurring. Naturally if your vehicle is grossly overweight and unroadworthy you deserve the book being thrown at you.
Elsewhere in Europe there have been several reports of motorhomes being weighed and fined for being overweight in the last few years, but how frequently this occurs is hard to say. I am pleased to report that whilst I have been stopped for a vehicle check I have never been weighed either in a Motorhome or as part of a race team over many many thousands of miles and four decades.

And then there is the insurance claim issue where your own vehicle may not be covered we’re it in a serious accident - oh sorry ones never known of an insurance company trying to wriggle out of paying out a claim because of a somebody not keeping to the legal requirements like bald tyres, no MOT, wrong type of licence. Think about the implications. Rant over!

You are making a good technical point although I have no idea if it’s 5% or 10% - not sure If I care either. Hopefully you know where I am coming from; you are parked at some traffic lights at the bottom of a hill with some dork coming up too fast behind you that has no idea of what weight they have - plated 3500 and 1000 overloaded trying to stop. Doesn’t work for me.

If it’s overloaded beyond its spec it could well be dangerous and a 1000kgs above would certainly be.

SVTech do not have more influence over the DVLA than any other company/engineer so that doesn't mean that using them will give you an 'advantage' enabling you to get your V5C back quicker, it's all down to the luck of the draw at the DVLA.

Yes I thought that, surely you don't receive a new V5 any quicker if Sv Tech do the work as opposed to Jr.
JR we're great and have just sent everything to dvla.
 
Manufacturers are allowed a 5% tolerance in the weight figures they give for registration purposes so it doesn’t seem unreasonable for us to be allowed a 5% tolerance if pulled over. Yes we should take care to comply with rules that are aimed at keeping us all safe but I suspect the enforcement agencies are primarily after those who are pushing things beyond 5%.
