Well that’s my five month holiday gone for a burton,

Had similar in Germany back in 2010. German driver heading towards me on my side of the road..I braked and swerved off the road and onto grass verge and stopped..Just as I stopped he hit my passenger door and ripped side panels and locker doors off the van and then bounced off rear axle..My van was driveable but not habitable..After the police had come and gone I strapped passenger door up and we returned home via Dunkirk..Insurance Co wrote van off on inspection..Luckily they paid out fully..I kept my no claims and have not been financially punished for future insurance..No injuries so lucky.BUSBY
 
Sorry to hear about your accident but you are safe.
Regarding insurance you will probably be 'low-balled' as a first offer as to value if written off.
You might be offered a figure to keep the van and arrange to repair it yourself.
If you would rather get a new van and aren't offered enough just tell the insurance company to find you a van to the same spec.
Had 2 vehicles written off (3rd party at fault)
I'd never accept their first offer

As it’s an Adria, any chance the insurance company could get it inspected where you are and possibly write it off there and then to avoid the cost of recovery. You should get three offers if you play hard ball. Start looking for the prices of comparable vans etc. if you have a lot of removable accessories when negotiating if the price is lower than comparable ones and the van is brought home you could build removing this of that to compensate the difference in pricing. I would be surprised looking at the van if they did not write it off given the availability of panels more so the interior fixtures and fittings. Wish you good luck.
 
LV looked at my Van but did not even consider writing it off ,, I guess different insurance companies have different policies in claims handling ,,,, Mind You Weston Motor Bodies did a superb repair job ,,,for £13k thats on a van that would have cost £40k to replace at the time .
 
Wow, terrible, you must be really shaken up. Was the Renault driver breathalised ?
Firstly, sincerely wishing you well and glad that you were not hurt.
But secondly, the breathalysed comment is a very good shout, as in Spain, their Christmas celebrations of the 3 King's are on the 5th and 6th of this month.
Could the driver of the Renault have been out celebrating over these days ?
Might be worth getting a good statement from any police attending at the time, of the drivers physical condition , if indeed they did attend.
Just my thoughts, but I hope it all turns out well for you, going forward.

If he was doing 90 (or was that you) what speed was he doing.

Of course. But in this case it's the self-report of the driver that may be interesting.

One can prove the phone stuff, if the right investigations are done. As one can prove the alcohol stuff.

But there are a limited number of reasons for crashing without braking into the rear of another vehicle on a motorway.

I wonder what the penalty is for saying "I fell asleep" rather than "I was fiddling around with my phone".
I was involved in an incident in the UK where a driver fell asleep in heavy slow moving traffic.
He killed a pedestrian.
He is now serving a 7 year sentence.

Driving 'without due care and attention' is better than 'dangerous driving'

Going at a fair lick I would say, he shoved us out to the outside lane, I narrowly missed hitting the centre crash barrier before steering both vehicles back to a too narrow hard shoulder,
I have four cameras recording constantly so should have video evidence of the accident,
Too shook up to view them yesterday,
Insurance said they will phone this morning so will see what they have to offer,

The driver didn’t appear inebriated to me, and as I was breathalysed I’m sure he was too,
I was busy clamping off a ruptured fuel pipe on the Megane that was pouring fuel into the rear of the motor home, after I had helped my wife over the crash barrier to relative safety I took the chance to isolate my rear battery, all scary stuff
I take my hat off to the emergency services, they where there in twenty minutes, but watching heavy trucks approaching while a good portion of my vehicle was sticking out into the slow lane is very unpleasant to say the least,
 
Crickey, he must have been travelling if both vehicles were going forward and he did that damage.
Should be in the police report. Would be interesting if you could get a copy.
Anyway the main thing is no one was seriously hurt.

That looks really scary, you did well to get to the roadside safely. Glad that no one was injured & hopefully the insurance claim will be sorted quickly for you and you can get back on the road.

Sad to see 1 less Vision around though.
 
Looks like you may have saved the other drivers life, driving literally into your garage has given him a cushioned crash, as opposed to a hard collision with a metal barrier and perhaps a journey off road. Sorry your trip has ended at least you are okay. Looks like a write off to me, for both.

Just what I thought.
Your quick thinking with the fuel pipe and batteries under the circumstances made the situation a lot less dangerous for you the other driver and road users too. I hope you get your insurance sorted out having the 4 cameras recording at the time of impact is s bound to speed things up for you. At least you are both safe with no injuries. Hope you get back home asap and get it sorted, to your liking.
