The TIE is your residency card but to get permanent residency you have to have done the 5 year process by renewing your visa twice more . Hopefully the renewals will be less traumatic than the initial application :unsure:

Yes - straight forward swap of old green residency card for TIE for a cost of €12

Just picking up on your CG point and selling in UK creating a liability in ES. I understood that the ES tax year is a calendar one starting on 1st Jan. So if you sold this year in the UK and became a tax resident in ES before 1st Jan 2023 you would have ES CG liability on your UK sale? Perhaps you can clarify your thinking? I have yet to decide if to get a visa, we bought in Estepona in March, but have no plans to sell in the UK so the CG issue did not stick in my mind. Good luck with your driving licence, its one of the things that makes me twitchy. 6 months after the date you get your TIE your UK licence becomes invalid!

Yes the tax year starts 1st January in Spain. This is the reason we couldn’t move to Spain until September because we have already had 2 months in Spain at the start of the year so we needed to make sure we kept below 183 days so that we won’t become tax resident until next year. The driving licence issue is making slow progress but shouldn’t be too much longer hopefully, if not Glynn will just take a test.

How does this work , in the above example they say the Spanish will tax your house sale in the Uk in the previous year? So a hous sale in 22 is declared and taxed in 23, does that mean that you can’t avoid paying tax on your 22 sale unless you wait till 24 before becoming resident ?

I am sure you've taken advice on this, but just in case you haven't do not forget that tax exempt wrappers like ISAs aren't tax exempt once you are a tax resident here. It may be worth bed & breakfasting any large investments with a capital gain as well. And if you're thinking about drawing down a tax free lump sum from a UK pension pot then do it before you leave, as it will be taxable if you do it when here. You will receive a lot of bar room advice, up to you whether you take it, but a free consultation with one of Blevins Frank's advisors is highly recommended. They are a highly respected tax and pension advisory service and are are in the very, very, few who are fully qualified and regulated here.

Yes it runs from the start of the year so if you have not been in spain at all then as long as you arrive after the 3rd July you are not tax resident for that year. So what Coolbeanz are doing is spot on.

And if you're thinking about drawing down a tax free lump sum from a UK pension pot then do it before you leave, as it will be taxable if you do it when here.
Also remember that any gambling in spain has an automatic 20% deduction from winnings before you recieve them This also applies to 'gambling' abroad which premium bond winnings are classed as.

I’ve no idea, we took advise from a tax advisor in Spain before we set our dates.

Well it’s been a crazy 2 months since we got back from a winter in Spain. We decided to sell up and move to Spain permanently as we are at our happiest when we are there. We put our bungalow on the market and it sold the next day!! We enquired about exporting our beautiful left hand drive Hymer but the estimated cost of €30,000 put paid to that idea however the friends we travel with jumped at the chance to buy it so that was another obstacle removed. It was with great sadness that we watched them drive off in it today. We move on Tuesday as the sale progressed really quickly. The other stumbling block was the strike at the UK Spanish consulates which was announced the week we sold our bungalow however we discovered today that the strike is over so no more hurdles hopefully. All we need now is our appointments for our visa applications and hopefully that will be the last hurdle sorted. We will buy another motorhome once we are settled in Spain. How exciting :dance2::gum::sun:

Getting everything in order for the consulate was the stressful bit as there was so much conflicting info and I wasn’t keen on paying €1,000 for an agency to tell me how to fill the forms out. I have now posted a copy of what we did on Costa Calida forum to help others so if anyone wants a copy anytime I can forward it. The biggest drag is the wait after submission which hopefully will speed up for others as they’ve now taken on over 200 staff to deal with the backlog. We were lucky we had somewhere to stay without having to rent a property for 6 months.

If the OP arrives september 2022 on then they are not "tax resident" this year .
When next year starts & June arrives , the time for the 'La Renta' tax declaration, then nothing is declared for the previous year 2022 , if anything is even submitted.
Until after 3rd july 2023 they still wouldn't be tax resident.
The following years La Renta declaration subnission in June 2024 will then cover everything from 1st January 2023. The house , or anything else from 2021 does not come in to it.

You are making great progress. We are seriously thinking of selling up in England for the same reason!

Everyone’s circumstances are different, from family to health and wealth.

We already have a house in Spain and would have liked to have applied for residency pre brexit. But family, business and many other reasons meant we didn’t.

Is it seems it’s a lot harder to apply with lots of added hurdles and costs.

We have seen another property we like in Spain to buy and have considered doing just what the OP have done.

But I’m not sure I want to sell everything, close my main business and then come across rejection for application.

For that reason, we are waiting in the wings to see what happens.
If you have a house that counts toward your finance surely. Will you be intending to work as a resident in Spain? Ifnot it’s easier to get a visa. They do seem to be coming down on the money side. If you are retired you can apply for a S1 form which helps with your health cover about like an EHic does on holiday.
