Consumer rights on rejecting motorhome

Hello,

We purchased an '04 plate motorhome from a dealership 4 months ago. We found the add on eBay and checked out the dealer, paid £500 deposit and drove to the other side of the UK to pick it up. When we got there we noticed water marks on the internal roof, we raised our concerns and the dealer did a damp check that showed 50%+ reading. He believed it was from jet washing the vehicle and told us to wait a few hours and he will reseal the sky light and stop the leak. We agreed and let him fix it. We had 3 months warranty and within that time we reported how severe the new leak is its dripping down walls, gone into the electrics and we have mould spores and rotten wood (see photos).

We have asked to reject the vehicle as its not feasible of financially efficient for us to drive over 300 miles to give him another attempt to fix it. We asked if we could take it locally to be inspected and have the work carried out locally. He refused and refused the rejection. We have contacted consumer helpline and they have advised we are covered by the consumer rights. BUT my question is has anyone else been down this route and what was the remedy. He is now saying its our fault for having the motorhome outside whilst its leaking (the leak he told us was fixed the day we purchased).

If I was the OP by the time they reopened I would be completly unhinged.:mad::banghead:
problem is Rich, there are cowboy dealers that don't give a toss and those that just make life difficult so the customer gives up and moves on. I am with you that I would be very angry, but would keep it amicable enough to agree a refund before giving them both barrels

hopefully it is because they have taken some professional legal advice and have been told to stop discussing it on a public forum!!!

Had a very bad leak on my new van just after I picked it up from Germany.
Contacted the manufacturer and spoke to the top chap in the service/engineering department, he gave me a few things to try but it was still leaking so he said cover it over with a tarpaulin!!!
Like I’m going to do that…
Next was the sales director who was an arrogant Wabbit and eventually said I should have bought an English van😳😳

So after that my solicitor I use in the uk has a brother who works with German firms and he gave me the name of a German solicitor, sent an email to the manufacturer rejecting the van and giving the solicitors name.
Straight away they said bring it back, no can do said I as we are in lockdown you had best collect and return it so that’s what they did, it was gone for 2 weeks and come back all sorted.

Have been back for warranty work when we visit Germany for the last 2 years and the service team are spot on just not so for the management🤬🤬

Thank you, we are based in North Lincolnshire and the dealer is in Devon. We have bought a damp meter which is capped at 40% and it maxed out with an alarm. On the photos you can see it's not something that has happened recently but he is just adamant he will not cover any costs. I have It booked in locally for a habitat inspection etc but not until 11th jan sadly.
Really got me worried, I am looking at a MH and its in a dealers in Devon, Do me a favour, PM me and I'll know if I am right to be concerned

op has more than enough evidence to reject the van. If the owner let that much damp invade think of all the other omissions on servicing, oil changes, cam belt change etc that may also have been overlooked? However the damp was reported on day 1 and the dealer given an opportunity to rectify. So it’s ready fir rejection. Elapsed time is important on rejections. File a legal rejection of the van immediately without waiting for the habitation service. Which have template letters as previously suggested. if you have legal insurance use it!

conning an inexperianced buyer is dispicable - ingress is a van killer and its very likely the seller didnt check or care that it was wet with dripping water , and to say dont keep a motorhome outside is laughable and is just taking the piss - have it idependantly checked locally with paperwork and photos and take to a solicitor and tell him your going to the local newspaper.
