Consumer rights on rejecting motorhome

Hello,

We purchased an '04 plate motorhome from a dealership 4 months ago. We found the add on eBay and checked out the dealer, paid £500 deposit and drove to the other side of the UK to pick it up. When we got there we noticed water marks on the internal roof, we raised our concerns and the dealer did a damp check that showed 50%+ reading. He believed it was from jet washing the vehicle and told us to wait a few hours and he will reseal the sky light and stop the leak. We agreed and let him fix it. We had 3 months warranty and within that time we reported how severe the new leak is its dripping down walls, gone into the electrics and we have mould spores and rotten wood (see photos).

We have asked to reject the vehicle as its not feasible of financially efficient for us to drive over 300 miles to give him another attempt to fix it. We asked if we could take it locally to be inspected and have the work carried out locally. He refused and refused the rejection. We have contacted consumer helpline and they have advised we are covered by the consumer rights. BUT my question is has anyone else been down this route and what was the remedy. He is now saying its our fault for having the motorhome outside whilst its leaking (the leak he told us was fixed the day we purchased).

You can name them when this is sorted, to tell us how fair and reasonable they were in helping you out.
Or shame them if it goes the other way

thank you that is a very good point. I am not wanting to name and shame just look for some advice to help us novices :)
I can’t see the problem naming them here. Everything you have said is factually correct. It might be the kick up the backside they need if they realise their public reputation is at stake .

You can name them when this is sorted, to tell us how fair and reasonable they were in helping you out.
Or shame them if it goes the other way
I just hope no one else would fall foul like we have, I've never known a company response to be so unprofessional for a motorhome dealer

This is the latest response, due to us saying we will not be covering fuel to Devon and back AND covering the expense for him to fix the issue that he sold us the first place. Why should we cover all the costs he wants to charge for a fault present at purchase that he has already assured was fixed.

Effing crooks, that’s disgraceful I really hope you win.
What an awful attitude looking back it was obvious him saying a skylight was leaking.

If it was me and didn’t have to have a dbs check every 2 years I would protesting outside his premises

Solicitor ASAP me thinks he sounds like a total arsehole.

Thick as two planks as well, where can most people store a Motorhome out of the weather.

All depending on the amount you paid. How did you pay for the MH and was it with a credit card?

I have used Section 75 before when I purchased a dodgy car using a credit card. They sorted everything out for me and the dealer folded quickly.

The other option is the legal side on your home insurance as others have mentioned. Good luck.

Thank you for your response. Please see below our response to your emails below.

1. Under the consumer rights act 2015, this motorhome should be of a satisfactory quality, fit for purpose and as described. My rights have been breached because the motorhome you sold me is faulty/ doesn’t match the description.
2. When my husband phoned you on 29/11/22 (also within 3 months) he did mention it is not feasible to drive the motorhome 300+ miles due to the condition it is in and if we could take it somewhere closer to home to have it sorted ASAP and you said no your garage only.
3. We have not ignored what you have said, it was advised to reseal the skylight, as you stated you didn’t believe us it was leaking. It is outside as it is a 7.5m long and not many people have anywhere to store these inside likes the ones you sell on your forecourt that are outside. It should be fit for purpose to be outside its a vehicle despite bad weather or not it should not leak and to the exact of the damp.
4. We did not see or receive any images of the repair as you state to show this, you just reassured us it was fixed and let us drive away in it. It was your mechanics that scanned the damp and showed us the reading of 58% when I mentioned the stains on the ceiling. On the phone call you told us to get a damp reading and like it said the highest the machine goes to is 40% so it’s clearly higher than that. Which was noted to you within the 3 months on 29/11/22.
5. We should not be paying for this repair as you state "not at your expense" therefore, how and why should we be out of pocket to drive it 300+ miles and then cover your mechanic who we don’t know who has already attempted a repair to fix which has been unsuccessful.
6. It was not 5 weeks ago it was 3 weeks ago and like i said its not feasible to bring it down at that point and no further solution was resolved. We have tried everything to stop this leaking, believe me we didn’t want to pay £24000 to leave sat on our drive rotting. The extent of the damage is beyond our control and needs a professional to remedy and sadly we can not control the weather.

We are not ignoring you but seeking a way to get this resolved for everyones benefit. It needs a lot of work doing on it to rectify all the damp and mould. This is not what we believed we was purchasing and your only solution is to cover the costs ourselves which is not legally right. We are covered by the consumer rights act within 6 months of purchasing the vehicle and if there is no solution to work together on this then we will have to exercise those rights. I now feel threatened by your last email your giving no solution except more expense and time wasted for ourselves after thinking we was buying something that was our dream for so long after my husbands cancer.

We are asking for you again to please work with us finding a local garage or professional motorhome mechanic to fix the damp damage and mould at your expense. If that is not an option then we would like to reject the motorhome within the consumer rights as the fault was raised the day we purchased and also gave you opportunity to fix it too.

I tried section 75 but as it was debit card and a bank transfer they class as 'bill payment' its not covered

Don’t mess about dealing with these Rob dogs anymore, whats the point they will just stick a bit of 10pence sealant on and let you take it back all that way.

You need your money back the only reasonable outcome.

I hope when it’s over you name them

Agreed! I am not bothering to respond now and my only option is to send my letter before action recorded post tomorrow and then instruct court proceedings online if no response in 7 days. I have to pay £1200 upfront its 5% of the claim

I think the the last thing they want is it repaired by those crooks.
I don't disagree but I somehow thought the dealer had to be given a chance to repair it (after sale) before rejection.

I assume you paid for it with a debit card . There is a Chargeback scheme that Visa, Mastercard & American expresses signed up to. You need to raise a claim within 120 days of purchase. Not the same legal cover as Section 75 with a credit card but worth investigating.

Obviously hasn't got a clue how to repair Motorhomes. Looking at your photos it would take a couple of weeks labour to repair that properly.

Yes but was that not before you took ownership? I had a similar problem a few years ago. In the end I agreed to let the dealer fix it. They had 2 attempts but collected it and returned it on both occasions. Thankfully its fine now. Good luck!
