Parked at my Local Shopping Centre (Peel Centre Stockport).

29th November 2024
After hours so no Charge

However,

They have sent me a

Parking Charge Notice
DO NOT IGNORE THIS NOTICE

With an Amount Due of £100 for not parking exactly within the Bay

This happened at my gym. The car park is council owned, also free to use & someone parked with just one wheel in the cross-hatch & got a ticket. I'm sure this is the same reason they've ticketed you 🙄
 
You’re going to have to read their notice board to see how cleverly they have worded it ,a miss placed full stop or comma could swing it either way ,does it say ‘park within marked bays AT ALL TIMES’ for instance?

In most car parks this represents a disability space and the hatching is to give extra room for less mobile individuals to enter exit their vehicle, by being over the line the van could be preventing someone who needs the extra room from doing that
 
What a shame Trevor. I think by definition you have not parked as instructed as you are partly on the hash makings rather than within the bay, petty I know but this is what they are like. Even though the hash area is to ensure sufficient space between vehicles for you to alight the vehicle it is, I suspect, not actually your bay. ☹️
 
You are not in the bay so haven't much hope .BUT whilst paying by cheque addressed to "the Pedantic Parking C****s ,followed by whatever name the scammers use I would be asking why they are employing people out of paid parking hours if not for the sole purpose to scam people who are touching the line?
Look on the bright side in some places a mirror overhanging constitutes " out the box"

And if you are parked in the hatched line you are risking damage from wheelchairs or scooters.
 
You could ask where it explains ‘failure to park correctly’….does it exclude hatched area and where does it state that is the case? Could you have found out when you parked etc?
 
Shame but they've got you this time..I hate it, common sense and throat parking woukd have just moved on..BUT...saying that there are m9bile cars now that take pics as they drive ip and down (aviods confrontation) and it's all generated automatically too I belive. Similar to this one on roodee where we are staying tonight.
And gone are the days where private parking companies go away if ignored.

It doesn't look like a disabled area as disable areas are usually yellow.
They are around here anyway...

I would just pay it, there is no way you can argue you were within the marked bay.

Look for technicalities and argue if you must, these companies do this for a living and are very good at it. You don’t adhere to the terms of parking and will therefore have been deemed to have accepted the PCN.

It sucks and I hate it too, it’s ridiculous! The current law in England and Wales however means pay up or possibly end up with a CCJ and an even bigger fine. Once courts and bailiffs get involved, it just costs you more, in stress and money.

I would be having a look on the Martin Lewis type websites. You have not paid to park so therefore you may have not agreed to their conditions for parking. If the parking is free then the paid conditions I would argue would be nullified. Its a penalty charge notice not a fixed penalty. Don't e mail or ring make sure all correspondence is written and posted and insist any reply is done by signed for registered post, it will cost them more time and effort and make sure its for raising one issue per letter that you send

It’s using, not paying that enters you into the contract.

Good point, depending on what constitutes contract

I use a council park regularly during free periods

Seen so many tickets for poor parking

The other week I stranded the van whilst I got the ticket in-between rain downfalls.intending to reposition once I'd got a ticket

Kind lady came up and said becareful your over the line they will book you.

Mine was at a similar angle to the photo when she approached.

What about i was over at the sign/machine reading the regs...i think the grace period is 5 or 10 mins.
