New laws in Spain Re cannot touch phone for navigation etc from March 22

Hi, just catching up on my Spanish news with Murcia Today HERE which says from March 22 you cannot touch your phone whilst driving for anything, including using it to reset your position etc whilst using gps navigational Apps

Not that I plan to be in Spain anytime soon, but does that include a SatNav screen too? Reading it it does say 'any devices'

I would say it does include sat Nav screens.
best to keep both hands on the steering wheel and have your passenger do the fiddling. (y)
 
I suspect it may be like the UK and relates to use of mobile phones only but could include such as an iPad or tablet I suspect as it is a device. If it were a Tom Tom then again I suspect that may be included too. You’d have to see the wording of the legislation.

I doubt very much it would cover use of integral factory fitted equipment on the basis the manufacture would be guilty of aiding & abetting the offence etc

My new Fiat Ducato will come, eventually, with no nav but will have car play so I’m guessing I will have to stop to do anything or get Sharon to do it, good luck there then 😜

Most vehicles these days have touch screens and controls that are to be operated by the driver while moving,.

Phones I understand as that avoids any confusion about using the phone and claiming otherwise.

Glad my Avtex tourer one (garmin 770) has voice command but I still find that distracting and try not to use it.
Also how would this affect newer cars which mainly use touch screen for a lot of stuff.
 
Already (or coming very shortly) here in UK too.
This is the UK rule which came in this year:

Using your mobile phone while driving

Stricter laws on the use of mobile phones have now come into force.

While texting or calling while driving is already illegal, it is now also an offence to take photos and videos, select a song on your playlist and play games on your phone while driving - even if you are stopped at a red light.

Failing to observe this rule could cost you a £200 fixed penalty and six points on your licence.

You are still be able to use your phone for directions, as long as it's secured in a cradle or you otherwise have hands-free access to it.

I think it will include any device that takes your attention away from driving safely.

Just because a vehicle has it installed doesn't mean it is legal to use it whilst travelling as you shouldn't really be touching and being distracted by anything that needs you to take your eyes off the road whilst driving, eg changing sat nav settings, radio stations etc, if you need to do that you should really pull over so you can concentrate properly. You can't blame the manufacturer of the vehicle for including it and you using it illegally, no different to having a high powered car and saying it's their fault that you were speeding.

Not really. Just because it's installed in the van doesn't make them liable for the owners misuse.

Most people control their phone, including viewing Facebook on their screen inside the car. So avoids the law, but still takes away the concentration.
 
It's always surprised me that screens (especially if not immediately in front of the driver) are permissible at all.
I thought there was a law that said screens with moving images must not be viewable by the driver, from the days when portable TV first became possible. I think the idea was good - that drivers should not be distracted from their task - but it was not extended to fiddling with the (unnecessary) radio. Radios were already present, so maybe the authorities did not want to face the wrath of people unwilling to change.
Nothing should distract the drivers attention. Even checking the speedo could be considered a distraction (unless it's a Fiat - which you know is unreadable). Voice response and instruction systems could avoid the need to cast your eyes away from the road (I have one beside me most of the time).

I wonder how the animated road hoardings have managed to pop up alongside busy highways (such as M6 spaghetti junction).
If anything's a blatant distraction, they most certainly are.
 
The newer driver aids such as "intelligent" speed limiters that are to become compulsory on new cars from July are also very distracting, and even quite annoying*.

Cognitive dissonance by legislators, much?


[*Road Departure Mitigation is easily the most annoying driver aid. It is on by default every time I start the car. ]
 
I travel solo and have always managed to find the time to pull over to alter my GPS.

I made the mistake of buying a new Citroen Cactus which had an annoyingly awkward (and to my mind, dangerous to use) touch screen.
I got rid of the car after 6 weeks of which four were spent looking for something else - with proper switches and knobs.

To use a phone you have to stop park completely clear of the road turn off engine and remove keys to ensure you can't be prosecuted.

I would have a problem taking my keys out as they just stay in my pocket :giggle:

All of the touch screen functions in my GLC, including the satnav, can also be controlled by buttons on the steering wheel, would this be okay to use when driving as it is no different to using switches for wipers, indicators etc?

I don’t think that is fully quite right. Most vehicles have buttons knobs etc that the driver has to touch rotate push etc to use them, and many are legal requirements such as lighting, modern electric handbrake application, then there are the safety ones like screen de misters. I’m sure they wouldn’t want you stop to switch them on and I’m afraid many would not be able to fully use them without taking their eyes off the road, even if for a second, to locate their exact position amongst the array of such buttons.

Changing sat nav or phone use is very much different, as they take a lot of time and are a big distraction and voice activation, which I have too, cannot do all you may want.

I personally don’t use it or use the phone/ sat nav whilst moving, only whilst parked, but incoming phone calls are answered automatically and I don’t have to do anything. All my other controls are mainly on the steering wheel, except lights & de misters so I don’t tend to touch the screen of the inbuilt infotainment centre & I don’t connect my phone to car play or use it to navigate with.

Perhaps I should of been clearer, or chose a fuller explanation of my thought, Re ‘manufacturer being guilty of aiding and abetting’ I would never expect or meant to suggest they would be prosecuted but for someone to build something that could, and likely be used, illegally whilst driving would not be appropriate to sell. I am of the view if the laws changed to say you cannot touch to adjust start etc a fitted sat nav whilst moving then the manufacturers would be expected to design something that could not be done so drivers who choose to act illegally cannot do so with their help. After all my car brakes for me, won’t allow me to drive with the door open etc so manufactures take such safety matters very serious these days and the EU has introduced many such measures to come into law at some point this year

It will be very interesting to see how modern motoring develops

Burgo I’ve copied and translated from your link the particular offence. Is this the current law, I think it is, and there is still a lack of clarity if it is the new one about what amounts to a device

“While driving, using a mobile phone without hands-free, reading or sending messages or using headphones (even just one) is grounds for a penalty. Also the manual use of browsers or other electronic devices.”
 
Common sense should prevail. The law should be needed only in case of extreme disregard.
Unfortunately, things are changing at such a pace that the law is unable to keep up.
 
Been driving out there for the last two months and the use of phones while driving is astronomical…. The police could have a field day and wipe out the national dept in a week, I kid you not…
