Make sure they stamp your passport

Arrived at the tunnel on New Year’s Day, through our passport control, then gas check, then French passport control.
Asked where are we going, Spain said I, how long? Seven weeks, are you aware of the 90 day rule? Yes said I, you are missing a stamp on both passports said she!
Crossed for 43 days from 1st May, stamped in and out.
Crossed for 21 days from 4 th September, stamped in but not out!
French lady then went away to ask for advise, held our breath for 5 minutes, then she came back and said ok enjoy your holiday. Phew!
Memories of getting to the port at bilbao and being told we could not board as the vet had miss dated billieboo’s passport!
 
Well, that's not what he has been told....and he spends a lot of time in Europe.

Settle it yourself for us and read the Directive 2004-38 EU and then come back on and confirm I’m right and your friend is wrong, which he is!

He says that all changed after Brexit.

The latest iteration (28/10/22) of the EU document the ‘Practical Handbook for Border Guards’ can be found HERE.

It takes into account the provisions for U.K. citizens contained within the Withdrawal Agreement and there is a specific Annex referencing it - Annex 42 Guidelines on the Treatment of Beneficiaries of the Withdrawal Agreement - although I’m unable locate a copy of that document at the moment.

It's possible that many border guards just see the UK citizen passport and automatically apply the 90-day rule. Rather than go through paperwork of checking the marital status.

Yes, and I can see that that is something that can only become more commonplace even with (or more likely because of!) the introduction of the proposed electronic systems.

It is because UK Citizens obtained different rights under the Withdrawal Agreement that those with Residents cards issued in EU countries were advised to apply for new ones under the Withdrawal Agreement.

I can remember gus-lopez for one pointing this out at the time.

& that is how to get slapped good & hard.paying good money for lazy ****s who can't do the job properly.

I don’t think the directive changed at. After all before Brexit third country citizens were limited to 90 in 180 days. What changed was the position of uk nationals in relation to directive.

The new scheme is supposed to be starting in May. Fingerprints, iris recognition, hamster's maiden name etc.
Iris recognition as a biometric measurement is pretty accurate and secure, the odds are 10^72 to find another match

Has anyone successfully avoided having their UK passport stamped due to EU spouse, and how exactly did you manage it. Thanks, Sean
