Problem with DVLA re: C1 , I need advice ....

I have had an actual C1 since 1987 when I was sent by employers to do one ,,, Im 65 now but 2 years ago when I moved house I sent license to DVLA and when it came back the C1 was missing . Apart from the fact I had passed a C1 and the grandfather clause They say I have to retake the test and get a medical , which is bullshit .. My new license at 60 had the C1 on it , and I have no medical issues and the DVLA know that ,, what can I do to get them to reinstate my C1 , I have had different excuses from DVLA ,

such as

Pre 1997 entitlements no longer valid
You have a medical issue .....????? not valid
at your age you need a medical ,, nope im not 70 yet
You never had a C1 ???? its on every license I had since 1976

I even spoke with MP about it but he had no effect
so what can I do to get the DVLA to fix their error !!!!!
 
If it's a full C1, test pass not grandfather rights, then I believe it's still medically tested at 5 years intervals as it's a commercial vehicle licence same as the old HGV 3 licence
Grandfather C1 expires at 70 after which is medical based

I lost my automatic C1 entitlement when DVLA reissued my licence following a medical issue, my understanding was that whenever they reissue your licence you lose the automatic entitlement, I did D4 medical and applied for C1 via form D2 and all good now, not sure that change of address should trigger the loss though :unsure:

Following on from the OP, it is ABSOLUTELY VITAL, (YES, I KNOW I'M SHOUTING!)

That on each and every occasion you have to send, destroy, shred, (you get the picture)
any document or Licence to any Government Department then that document
is COPIED, AND RETAINED EVERY TIME!

I keep copies of every license I have ever had back to 1976 ,,and have sent photocopies to DVLA , I passed a DVLA Medical when I was 63 due to a medical issue and the C1 was on the license then ,, so I none the wiser why they are refusing to sort out the problem now ??

You seem to have had a confusing selection of reasons/excuses from DVLA which one are the complaints team endorsing?

If you have been to your mp and also the DVLA complaint process then you have probably exhausted your options with them directly.
I would ask them for the details of their appeal process and who is the ombudsman who oversees their conduct.
Then go to them with the evidence and a strong complaint.

Sometimes it needs a metaphorical 'kick' to fix 'stupid.'
Rather belatedly, I have to apologise to Phill D.
My comments were targeted at the DVLA.
(At least Phill D knew who I was kicking)

It's sad to say how many do not check.liciences when they are returned to.them or keep copies before sending to dvla.

All the details are available on.line so before requesting changes copy and save the details they have

jerryz has this issue been going on for 2 years 😳

They left categories off mine on the last renewal it was rectified within days of the licence being issued and checked on receipt.

This time scale is unacceptable

Have you checked your entitlements using the licence allocation data page as per above.

I did not know about that website (thanks Nigel P0 so I just checked it and my C1 entitlements are missing ??? But the DVLA have admitted I had them in the past ,,, hmm and they have had copies of all my old licenses so its difficult to understand why they are prevaricating .I will write to the Ombudsman .

When you contact DVLA just raise the issue of GDPR, they have a legal duty to make sure any data they hold on you is accurate, relevant and up to date. If it is not, you can require a prompt remedial action or they face a fine! Might just tip somebody out of their seat and get on with sorting it out!

Article 5(1) requires that personal data shall be:

“(a) processed lawfully, fairly and in a transparent manner in relation to individuals (‘lawfulness, fairness and transparency’);
(b) collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes (‘purpose limitation’);
(c) adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed (‘data minimisation’);
(d) accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay (‘accuracy’);
(e) kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required by the GDPR in order to safeguard the rights and freedoms of individuals (‘storage limitation’);
(f) processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures (‘integrity and confidentiality’).”
Article 5(2) adds that:

“The controller shall be responsible for, and be able to demonstrate compliance with, paragraph 1 (‘accountability’).”
This is a useful resource when dealing with data management across most fields.

Get your MP to raise a complaint here:


You may need to tell your MP that this service exists as many (including mine) were unaware. My license was returned within a week of the complaint to the ombudsman but had a full C as well as the C1 entitlement but no +E. License has been renewed again since then with no issues and my correct entitlements :)

I know a lot of motorcyclist who have had this happen ,, it was a major scandal a few years ago , some who had licences for over 30 years had to take tests as DVLA had lost all records from the 60s and 70s the excuse was the records had not been transferred to new computers .
