No habitation cert so warranty void

Picked up new (2021 Swift Kon tiki) van on 10th July and all went well. On site that night and found that the 240v charger was not charging. Found a burnt plug on the underside of the sarget panel so contacted the dealer. Firstly Swift said its sargets issue and visa versa. Got an answer back from Swift and they say because they do not have a habitation cert for 2022 the warrenty is void. I have manged to get the dealer to pay for a new sargent control panal and this is being fitted as we speak. However my issue is trying to get a copy of the 2022 cert if it was carried out? I was assured by the dealer that is was FSH when I purchased the MH. I have contacted Swift to see if they can contact the previous owner but have been told not possible. In the mean time the dealer is trying this route however if it comes to no history we are thinking of rejecting the van by means of the 30 day rules.
Any ideas of how to proceed would be greatly appreciated.
 
How much warranty were you expecting? I thought it was only two years.

How long is the Swift warranty valid for? If it is only two years it will have now run out. I think they are three years for bodyshell but that won't cover electrical stuff.

If you like the vehicle you might consider getting a certificate for this year if you don't already have one and twisting the arm of the dealer to cover the bodyshell for 12 months.

Just reject it now. Either they wont find it and you have to reject anyway, or doing so will spur the dealer into action to sort it for you.

We have the one for 2023 just been completed the day before we picked it up. The warranty from Swift is 3 years and 6 years for the body. The body is my main concern

Does the dealer know that Swift has removed the warranty?

Is the dealer working to reinstate the swift warranty?
If not…..
Is the dealer willing in writing to to provide the same level of warranty that Swift would have?

Assuming none of the above , I would be inclined to send a formal letter / email to the dealer stating the van is not as advertised and they have 10 days to correct the problem before you begin the legal process of returning the van.

I fear you may have a hard time with that as it’s only a habitation check missing is it worth the hassle if you like your van and it’s not got any other problems? I think Swift are being a bit difficult and perhaps trying it on a bit I would go to the dealer and tell them what you are proposing and see if that shifts their backside😊

I contacted by email yesterday including the MD and asked for this to be sorted no reply today but will send an email informing them about legal action if I get no answer

After reading above comments got the grump on and thought Right I'm going to shout even louder. So sent not very nice email and got reply straight away. Dealer looking into previous owner to get paperwork and hopefully get it sorted once and for all. Will keep an eye on the days though already at 21 so only 9 days to reject it under the 30 day rule.

Is it just habitation service not done? What about the damp warranty. Engine side of things?

I'm not sure of Swift but with my Burstner habitation is just 2 years and no service needed for that.
Damp is 10 years and require water ingress check once a year.
If it is a Fiat base vehicle like mine then it needs a engine/chassis service every 2 years or 30,000 miles.

Yep exactly the same for the engine side 2 years which the dealer did so that's fine because it's only 2 years warranty with fiat. Its just the swift side that I need the yearly habitation check to keep up the warranty

Think I would have asked for full service and full damp check before taking out of their depot.✅
2021, dealers seem to be quick on the mark for saying it’s 3yrs old so no habitation and water ingress check ?
Used to be Common fault with Swift 🤷‍♀️

That was the problem, I got the 2023 habitation cert the dealer did and the service reciept for the fiat but then later fond out no 2022 habitation cert. In hindsight I should have checked for the previous cert. Hopefully they can contact the original owner/dealer and get a copy. Swift have said they will reinstate the warranty if I can get a copy.

then the dealer should ENSURE! a copy is available no matter what they have to do.

Think you have to reregister the van with swift in a certain time frame and pay a fee ,around £50 or so ,so just check out the terms and conditions of the warranty transfer. Swift will wriggle out of any warranty work if they can. Plus try and get hold of the 2022 hab check receipt. I have been asked for that from eldiss. The report apparently is not 100% proof of a hab check as can be back dated.

A day after we picked it up did all the transfer with Swift sent copy of V5 when it arrived all went well until the garage where the repair is being carried out contacted Swift. The dealer ordered a new sargent control and will obviously try and get the money back from Swift. So hopefully this will kick them up the backside to get their money back because at the moment they will be about £700 out of pocket. Fingers crossed they can get a copy of the cert. Also I can't imagine the first owner of a brand new van over 100k not having a habitation check carried out.

The first hab check may have been a freebie one ,was it purchased from the same dealer where you bought it from?Best of luck with Swift on that.

No it was another dealer in Liecester, the dealer I had it from are contacting them. Cheers, mind you I have it in an email and they have accepted the one that has just been carried out. But I know what you mean they can be a little bit awkward

Update!!

After telling the dealer they can have their van back because of no warranty they have located 2022 habitation cert so Swift will be up dated and they will reinstate my original warranty. Great news because we really didn't want to give the van back Lol.

I would ask swift for confirmation that the warranty is valid for your van. It's easy to print out a hab check and back date it. You also need a receipt for the payment ,even if it was a freebie .
If you accept the van advise in writing that it is subject to confirmation of acceptance by swift.

Hi,

We already have the van but have spoken to Swift who will update my records once the copies have been sent over. I've told the dealer its got to be done by Monday close of play because the 30 day deadline is up on Wednesday. So he will be getting the van back if its not reinstated.
