MH was advertised with Solar.

Hi, looking at purchasing a second hand Motorhome, the seller advertised it as having Solar, also stated verbally on viewing it had Thatcham Cat 1, it now appears neither off this is true. We signed documentation that we would exchange our vehicle in order to obtain this other vehicle. But have only now found this out whilst awaiting the vehicle to be repaired for release to us.

Should this dealer be expected to fit Solar? Can we legally refuse to accept the Van on the two points stated? Apologies for long winded post but wanted to explain fully, hopefully anyway. Appreciate any feedback from experienced members. Thank you.
 
I would expect that if you are buying it as advertised it should have what you are buying, otherwise anyone could advertise anything with a plethora of extras and be a completely different item.

Thanks for responding, I’m hoping someone could provide what the legal status would be off basically entering into an agreement. The Solar I have evidence the Thatcham Cat 1 was verbal. I’d like to know if could just terminate from the
deal?

Do you have the original advert? Without anything in writing it's going to be difficult to prove what was said. It would make me worry about any other problems that might be present and how good they are going to be at any warranty work.
Yes, I have a screen shot which declares the Solar. The Thatcham alarm was verbal. Naturally we signed an agreement, this is why I’d like to know if we can withdraw from going ahead?

It all comes down to how much you want this particular van. If you're not bothered then insist the van they sold you is as advertised. They will either make sure it is or won't, leaving you with the option of either proceeding or not.

It wouldn't hurt having a chat with citizens rights type organisation...

Hi, last time I enquired at Citizens advice it was weeks and weeks later before I could get the required advice from them. Time rules that approach out.

What was the specific wording for "solar"? I would expect it give a wattage, say 100W or something like that. If it was specific but is not actually present then I am sure you can cancel but you may have to give them the option of fitting it. However, they may only have meant it "solar ready" and might have a solar charger already fitted but no panels.

It depends on how much the dealer wants the sale as it's peanuts for them to fit solar so if they do they have kept to their original sales blurb

Have you paid a deposit? Paid for the MH in full?

I would say that you are within your rights to refuse the MH unless they bring it up to the spec stated. Give them that option, otherwise refuse to proceed, before you collect the MH.

If you havent paid, then you can check to see if they are intending on putting these extras on before you collect, if they decline or say it was a mistake, then I would refuse the MH (if thats what you want to do).

If you have paid, then you will need to ask for your money back, you may have to go through a disputes mechanism if on your credit card. Either way you should make and keep records of your negotiations in case it goes to a small claims court.

I would politely ask him to fit solar or stick his van !

You definitely can reject any vehicle that is not as described even after you have taken possession of it .

I'd push for the solar to be fitted. Not a huge job for a dealer and if they moan about it you should name and shame them. Not sure about the absolute legalities of this how ever, unfortunately.

What are they repairing on the van?

Sounds like you have already done the deal. Verbal assurances form part of your contract, but of course they are harder to prove.

If it were me, I would set out in an email, exactly where they have come up short and what you want them to do about it. Keep it polite and professional, no threats of taking it to social media or other such unpleasantness. Discounts will be better than having them poorly fit rubbish gear just to appease you.

How they respond to that will make your next steps more obvious.

It might mean one of those little solar panels which sits on your dashboard and will charge a mobile phone. It’s possibly stored in a cupboard somewhere 😉

If you haven't paid anything and don't want the van, don't have it, end of, as they say.
If you have paid something and really want it , go for a reduction in price and just get on with it.
Solar no big deal, £200 all in , alarm,you will probably be adding another one anyway so, go for £250 off and do it yourself,simples.

If you didn't view the vehicle you may be able to reject it under distance selling rules, however if it's not as described then AFAIK there is no obligation to continue with the purchase as this equipment influenced your decision to buy it at the agreed price, of course you could agree to a reduction to allow for it and the alarm.

Where is your van the one your are trading , if it with you don't hand it over, you can always go for charge back , how did you pay the deposit.
If you have solar etc tell them youll take it off to put on the other one.....

Pushing the dealer to fit solar is likely to result in the smallest, cheapest panel, together with a cheap controller. I would have agreed a reduction in price and fit myself at a later date.

What van model/year?
Thatcham 1 can be factory default.
I believe ours does from factory.

If the van turns out to be a lemon how confident would you feel about getting a good outcome 🤷‍♂️
Is there any dealer feedback to be looked at?

I once bought a car which was not as advertised, I contacted the dealer and agreed a reduction. Cancelling the purchase would not have been easy as we traded in our old car and by the time I noticed our old car had moved on.
