My wife as a Irish Passport (EU), I have a British Passport. What is the current situation on traveling in the EU regarding 90 / 180 days.
Having amassed as much information as possible, page 20 and 21 of the Border Guards Handbook, Marriage Certificate, emails to and a reply from the EU, and a extract from the Sunday Times travel section.
The available information is very confusing.
Hopefully someone may be able to pass on some concrete information on the situation.

I understand you can travel with a spouse who is a EU citizen without any time limits.

Not sure how it works if you travel independently like for work of boy’s jollies trips.

I also have an Irish passport and have used it for 3 trips of more than 3 months with my husband. As long as you are travelling together for the trip you have the same rights as the Irish passport holder.

As a precaution we keep receipts etc. along with photos of us together but so far haven’t needed them or our marriage certificate.

We travel via the tunnel for info.

A boys' jolies for more than 90 days would be some party.:LOL: But probably divorce papers awaiting return!

I also have an Irish passport and have used it for 3 trips of more than 3 months with my husband. As long as you are travelling together for the trip you have the same rights as the Irish passport holder.

Only one customs official ever commented on being out for more than 3 months (probably because they were not aware of the rules), I confirmed verbally we were married, asked if they wanted to see our certificate and the reply was no thanks, that’s okay.

So, so far so good 😊

For the practicalities of entry/exit to the EU as a third country national you also need to look at 6.2 of the Border Guards Handbook (pages 74-75). Your passport will be stamped, (unless you hold a residence card), your wife’s will not, but as you are accompanying her you are not subject to the 90/180 restriction. Retain copies of joint ferry bookings etc. as evidence of joint travel should you be queried as to why the entry and exit stamps do not tally.

I think that’s the issue. The guards at borders don’t always understand the rules in our experience.

The rules are actually pretty easy to interpret Directive EU2004-38 provides details of an EU citizen’s right to roam and that their spouse (and immediate family) may accompany them. This nullifies 90/180 for the third country national (British passport holder)

So that’s the rules… the interpretation by individual border officials is very different and with our extensive experience, not widely known (trained) about!

If you travel separately you simply have to abide by the 90/180 rules like every other third country national does.

I expect non-EU citizens, travelling with and EU spouse is a very small percentage of the travellers they deal with. I hope when the new visa system is in place it will have this as an option 🤞

Any chance of you applying for an Irish passport as well as you are married to an irish citizen ?
(Even if this means you have to register an address in Ireland to prove you 'live' there)

If I had any chance of getting another passport I'd jump at the option with both hands!

No idea. It’s a bit of an unusual situation I guess, so the training is focused on 99% of the border crossings not <1%. No real excuse though!

Resident in Ireland for at least three of the last four years are the qualifying criteria.

I hope when the new visa system is in place it will have this as an option 🤞

Or it might make it worse if it relies on ‘computer says no’ and then requires manual intervention and a delay, rather than the border officer first being able to make a judgement call based on the evidence in front of him.

What are the practicalities of passing through passport control when a couple have two different passports? Which queue (UK or EU) does one join or does one half have drive through the relevant channel while their partner walks through the other one?

The shortest one!

Not been a problem for myself and Irish wife as there’s not been a choice on the ferry and tunnel routes we’ve taken.

Does anyone know how the impending EES will affect UK spouse of an Irish passport holder. I am assumoing that EES does not apply to the Irish passport holder.

You assume correct. TBH, I’m a tad concerned it’s going to be a nightmare correlating my travel history to my EU passported spouse. 🤞

Vehicle crossing points, it’s the same Q! Airports it’s a case of, see you the other side. My wife (EU passport) hangs around in case I need to prove anything WRT overstaying! ✔️

You need 2 years residency
