GVW Taxation Class

Just found out that my MH has MAM 3650Kg stated on the V5C but it‘s taxation class is private light goods. My understanding is that if it’s over 3500kg it should be PHGV and thus lower VED. Just been on to DVLA and the person I spoke to said that I require to get a Weighbridge ticket to demonstrate that the vehicle is indeed over the 3500kg and send off V5C with covering letter requesting change of taxation class. Anyone had the same problem? Would appreciate any response that may possibly clear up my confusion regarding this ‘grey’ area.
 
I have no expertise in this area but the DVLA response seems crazy to me. Almost anyone with a van could load it to more than 3500kg and then get a weighbridge ticket even if their MAM is only 3500kg.

Surely the tax class should be based on the MAM not the weighbridge weight?

Must have been a bizarre conversation with DVLA. The relevant issue is what the vehicle is permitted to weigh not what it actually weighs! A weighbridge ticket is completely useless, you could put a load of sand in the back of an escort van to get to 3500+ but it wouldn't suddenly become an HGV! The current plate, if provided by a converter, would also come with the appropriate certificate which is what DVLA use to update the V5C.

If you are happy that your MoHo is indeed 3650kg, and your licence is suitable, I’d ignore the ‘advice’ from the telephone drone and simply write a letter to the DVLA, with a photocopy of the relevant page of the V5C, requesting that they rectify ‘their’ mistake and amend it to PHGV - and of course request a refund of VED at the same time .

I have two plates on my van. 3650kg for the chassis ex factory and 3500kg builders plate after the body added. Have you looked to see if you have more than one plate?

Mine was 3650 from new and I used SVtech to uprate to 3850 (with driverite air).
The V5 came back updated to 3850 and clearly states Private HGV, so yes sounds like a dvla mistake to me.
The plate is meaningless if the V5 doesn't get updated to reflect it.

The next person may give a better response.
If you point out the MAM is correct (by their records) but the tax class is wrong.

If you ask what day is it half the desk jockeys won't know.
I think they are only there to keep warm.

I have two plates that both say 3650Kg GVW. Appears that most of the desk jockeys at DVLA couldn't tell you which day it is !?!?!
