That is definitely not a kestrel and I am not certain that it is a sparrowhawk either. To be more certain we need an idea of its size. If it was as big as a buzzard, it could be a Goshawk. The obvious white 'trousers' suggest this, as does the shape of the head. If that is what you have seen, you are very lucky. Where was it in the country?We had a five minute view of this think it's a young kestrel
A few years back it allowed me to take this picture of it less then 10 ' away

Nice shot, a first summer male I think. The barring on the tail is distinctive, on adults it is much finer.We had a five minute view of this think it's a young kestrel

was about a 9"-12" in height just sat there as if resting

Well spotted JeanLuc, I didn't notice the eyes!OK, at that size it is definitely not a Goshawk. Definitely not a falcon (kestrel, merlin etc) as they have black eyes. Hawks have a yellow ring. Most likely is an immature male Sparrowhawk.
